Abstract

 

This article examines the strategic role of notaries in contemporary land law reform through a historical reflection on the Islamic legal civilization of the Banten Sultanate. The study addresses the persistence of agrarian conflicts, overlapping land claims, uncertified ownership, and tensions between positive law and socio-religious legitimacy in Banten Province. Using a normative and socio-legal legal-historical approach, the research analyzes statutory regulations, historical records, scholarly literature, and contemporary agrarian developments. The findings demonstrate that the Banten Sultanate developed an integrative legal system combining Islamic law, customary norms, and state authority, particularly in land administration and dispute resolution. These historical values remain relevant for contemporary legal development. Notaries occupy a strategic position as legal intermediaries capable of harmonizing formal legality with community values. The study concludes that an interdisciplinary notarial approach incorporating positive law, Islamic legal principles, and local wisdom can strengthen legal certainty while promoting substantive justice in land governance.
